Originally published in 1981, Dr Currie's main emphasis in this book is on the economic theory of agricultural land tenure, but he also makes extensive reference to the historical development of land tenure in England. After consideration of the history of economic thought on this important topic, he employs an essentially neo-classical approach, though one that pays due attention to the nature of institutional arrangements and particular forms of property rights. In dealing with these latter aspects, he considers not only (...) the economic effects of particular institutional forms but also their economic causes. The careful use of the history of land tenure development gives this work especial relevance for agricultural development and for issues of land reform. The Physiocrats and Classical economists gave land tenure an important place in their work. Following a long period of' neglect by Neo-Classical economists, land tenure arrangements again received considerable theoretical attention in the years preceding publication. Recently there has been an outpouring of consumer frustration over rising food and energy prices. Many politicians railed against “speculators” who allegedly drove up the prices of key necessities. Is speculation unethical? This article reviews the traditional arguments against speculation. Many of the standard criticisms confuse speculation with gambling. In much the same way as ethicists now draw distinctions between usury and normal business interest, we draw a distinction between socially useful speculation and gambling. Gambling involves taking on risk with (...) no plausible expectation of making a profit. Gambling may provide entertainment value to some people, but like other addictive activities causes grave harm to a subset of users. Speculation involves taking on a business risk with a plausible expectation that a profit will result. Speculators provide an important risk bearing service by taking on risks that others do not want. They help markets to function better by helping to incorporate information into prices as well as providing liquidity. Speculators may actually reduce shortages by causing quicker price increases that motivate producers to increase production and consumers to conserve. But even socially useful speculation may have an ethical dark side. Does such speculation cause damage by adding excess volatility to prices? Speculators may contribute to price bubbles. At what point does legitimate speculation become odious “price gouging?” We also draw an ethical distinction between speculation, which seeks to benefit from changing prices, and manipulation, actions taken to push prices away from their economically appropriate levels. This paper examines the ethics of contemporary managerial compensation in the context of executive stock options. Economic considerations would dictate that executive stock options should be adjusted to eliminate the effect of overall stock market movements which are beyond the control of the executive. However, in practice, most executive stock options are not adjusted to control for these outside factors. Agency considerations are the most likely culprit. Adjusting for the influence of outside factors, such as a generally rising stock market, (...) from executive stock options sets a higher bar for managers to reach. Furthermore, traditional accounting standards permitted firms that did not adjust options to avoid reporting options as expenses. This presents CEOs and boards of directors with a major ethical dilemma. On the one hand, their duty to their shareholders and stakeholders dictates that executive stock options should be adjusted to eliminate outside noise from unrelated movements in the overall stock market. However, financial statements are presented in the language of accounting. If the overwhelming majority of the users of a language define a particular item in one way, then to deviate from the norm implies that the recipient of such a deviant statement may not properly interpret the statement. Likewise, if the standard practice is for firms to use unadjusted options and thus under-report expenses, to deviate from this industry norm risks that users of financial statements would not properly interpret the financial statements, with perhaps negative consequences for the shareholders. In short, if "everyone else does it," then it could be wrong for an individual firm to deviate from the norm as that would harm the shareholders. (shrink)

The controversy over short selling has continued unabated from the introduction of modern equity trading in Amsterdam in 1610 to the present day. Nevertheless, the business ethics literature has not really addressed short selling. Short sellers not only profit from the misery of others, they also create it through their selling activities. However, they also provide a socially useful service by making prices better reflect true values, protecting other investors from purchasing overpriced securities. Short sellers can also help to provide (...) liquidity in the markets. Recently, there has been a hue and cry against so called "naked" short selling, which involves not delivering the shares that have been sold. This gives manipulators a tool for depressing stock prices and deprives purchasers of voting rights and potential stock lending revenue. Naked short selling creates ethical issues for short sellers, buyers, brokers, market makers, and regulators. Is it ethical to exploit a legal loophole that permits sellers to sell stock and delay delivering shares indefinitely? (shrink)

Much historical insight is given to ground the various philosophical strands in Jefferson’s thought and writing on topics such as political philosophy, moral philosophy, slavery, republicanism, wall of separation, liberty, educational philosophy, and architecture.

Scientific misconduct includes the fabrication, falsification, and plagiarism (FFP) of concepts, data or ideas; some institutions in the United States have expanded this concept to include “other serious deviations (OSD) from accepted research practice.” It is the absence of this OSD clause that distinguishes scientific misconduct policies of the past from the “research misconduct” policies that should be the basis of future federal policy in this area. This paper introduces a standard for judging whether an action should be considered research (...) misconduct as distinguished from scientific misconduct: by this standard, research misconduct must involve activities unique to the practice of science and must have the potential to negatively affect the scientific record. Although the number of cases of scientific misconduct is uncertain (only the NIH and the NSF keep formal records), the costs are high in terms of the integrity of the scientific record, diversions from research to investigate allegations, ruined careers of those eventually exonerated, and erosion of public confidence in science. Existing scientific misconduct policies vary from institution to institution and from government agency to government agency; some have highly developed guidelines that include OSD, others have no guidelines at all. One result has been that the federal False Claims Act has been used to pursue allegations of scientific misconduct. As a consequence, such allegations have been adjudicated in federal courts, rather than judged by scientific peers. The federal government is now establishing a first-ever research misconduct policy that would apply to all research funded by the federal government regardless of which agency funded the research or whether the research was carried out in a government, industrial or university laboratory. Physical scientists, who up to now have only infrequently been the subject of scientific misconduct allegations, must nonetheless become active in the debate over research misconduct policies and how they are implemented since they will now be explicitly covered by this new federal wide policy. Pp. v + 152. $16.95 (paper). The thesis of this potentially revolutionary book is nicely summarized in its title: the basic flaw in ecumenical theology is the unbaptized-that is, insufficiently trinitarian-God of Christians East and West, Protestant and Catholic. The book is revolutionary because it proposes a new way of reading (...) the logic of a myriad of ecumenical dialogues over the last quarter century; as a result, ecumenical theology and praotice for which God is among the " settled " issues ought be appropriately chastised by this book. But I think that Unbaptized God is only "potentially " revolutionary because I think Jenson leaves two crucial questions unanswered. Jenson's daring argument is made with rare clarity and compactness. Consider the argument in three stages. First, in an introduction, Jenson describes " the frustration of dialogue." He does not mean the frustration created by the meager knowledge or acceptance of the results of ecumenical dialogues on the popular level-or the reception without action of these results by Church officials (p. 2). He focuses on " a third mode of frustration ": a dialogue will proceed toward a " convergence," not without "tolerable divergence "; but the initially tolerable divergence eventually yields " a newly virulent division." The process is seemingly "circular" (p. 3). "No set of convergences ever seems to be enough, once the separations are there " (p. 4). Why? And what can be done about this? Second, Jenson illustrates the frustration and starts showing the way beyond it in several different ways. He describes the dialogues in the first two parts of the book. In Part One, Jenson takes up "The Early Ecumenical Convergences " on issues central to the sixteenth century reformations, Ca.tholic and Protestant: Justification (ch. 1), Real Presence (ch. 2), and Eucharistic Sacrifice (ch. 3). Part Two takes up Churchly Office (ch. 4), Episcopacy (ch. 5), Roman Primacy (ch. 6), and The Church's Mediation (ch. 7). The distinctions between the issues of Part One and Part Two seem to be both historical and logical. Historically, the issues of Part Two are what Walter Kasper called the surprising "displacement of the problematic" (p. 44) from issues 677 678 BOOK REVIEWS considered central by Trent and the Reformers (especially justification and the eucharist) to issues that emerged after the Reformation (especially ecclesiology). Logically, the distinction between Part One and Part Two is the distinction between the traditional matters of controversy (Part One) and what are claimed to be differences "hidden at some conceptual level deeper than that occupied by the traditional matters of controversy" (Part Two) (p. 7). I will not rehearse Jenson's splendid summaries of the many dialogues in English, French, and German (although the book ought be recommended on these grounds alone). The unofficial Groupe des Dombes is regularly regarded as the most ecumenically insightful, and the Dominican J. M. R. Tillard plays a particularly crucial role among Roman Catholic theologians. It is enough to say that Jenson successfully shows how each dialogue can be read as an instance of the frustration he initially mentioned: a " convergence " occurs on each topic which later turns into a " divergence " which later is converted into a " convergence " and so forth. By the end (ch. 7), everything seems to circle back to the doctrine of justification (ch. 1). But the appearances, Jenson argues, are deceiving. "The pattern of the dialogue's history proves to be more like a spiral than a circle on a plane" (p. 103). Thus, besides describing the dialogues, Jenson must also prove that the dialogues exhibit a non-circular movement. One of the fascinating features of Jenson's argument at this stage is that he does this in a slightly different way in each of the first seven chapters. For example, he sometimes clears away "illusory dissensus" (p. 22). He sometimes concludes that "the Catholic side is right." Indeed, the Catholic side seems right on most crucial issues-on convictions about the temporal constitution of persons that constitute the background for arguments over Real Presence (p. 32); on the "new" Catholic theology of eucharistic sacrifice (p. 41) ; on episcopal succession (p. 74... The decree of Themistocles, discovered by M. H. Jameson and first published by him in 1960 has given rise to an intense debate centring on the question of the decree's authenticity. This debate has focused to an important extent on supposed archaisms or anachronisms in the text. If a word appears to be used in an ‘archaic’ manner, i.e., in this instance, one peculiar to the early fifth century, it may be an indication of the inscription's authenticity. Conversely, a word (...) employed in a manner proper to a later time may be an indication of the decree's actual period of origination. Thus an early and influential commentator, D. M. Lewis, argued for the decree's authenticity asserting: ‘I see no reason to suspect a forgery. There are too many traces of official and archaic language.’. (shrink)

This study seeks to present the theory of freedom as found in one line of the Marxist tradition, that which begins with Marx and Engels and continues through Lenin to contemporary Soviet philosophy. Although the primary goal is simply to describe how freedom is con ceived by the thinkers of this tradition, an attempt is also made to ascertain whether or not their views are strongly deterministic, as has often been presumed by Western commentators. is in order regarding the scope (...) of the term 'contemporary A remark Soviet philosophy'. The Soviet stage in Marxist philosophy stretche. s back to the 1917 revolution. However, for the purposes of this study only works published after 1947 were examined, and the vast majority of them date from the 1960's. Apart from the fact that most works of previous periods were not available, bibliographical indications, such as the titles of the articles in Pod znamenem marksizma, did not suggest that the theory of freedom was then a major concern. In fact, even 1947 there was little development of this theme until the upsurge after of works in philosophical anthropology during the last decade. On the other hand, it is not being suggested that the conception of freedom found in recent writings is representative of earlier Soviet philosophy, during the Stalinist 'dead' period or earlier. DBS Think Tank IX was held on August 25–27, 2021 in Orlando FL with US based participants largely in person and overseas participants joining by video conferencing technology. The DBS Think Tank was founded in 2012 and provides an open platform where clinicians, engineers and researchers can freely discuss current and emerging deep brain stimulation technologies as well as the logistical and ethical issues facing the field. The consensus among the DBS Think Tank IX speakers was that DBS expanded in (...) its scope and has been applied to multiple brain disorders in an effort to modulate neural circuitry. After collectively sharing our experiences, it was estimated that globally more than 230,000 DBS devices have been implanted for neurological and neuropsychiatric disorders. As such, this year’s meeting was focused on advances in the following areas: neuromodulation in Europe, Asia and Australia; cutting-edge technologies, neuroethics, interventional psychiatry, adaptive DBS, neuromodulation for pain, network neuromodulation for epilepsy and neuromodulation for traumatic brain injury. The study of anarchism as a philosophical, political, and social movement has burgeoned both in the academy and in the global activist community in recent years. Taking advantage of this boom in anarchist scholarship, Nathan J. Jun and Shane Wahl have compiled twenty-six cutting-edge essays on this timely topic in New Perspectives on Anarchism.

Background: Post-mortem needle biopsies have been used in resource-poor settings to determine cause of death and there is interest in using them in Bangladesh. However, we did not know how families and communities would perceive this procedure or how they would decide whether or not to consent to a post-mortem needle biopsy. The goal of this study was to better understand family and community concerns and decision-making about post-mortem needle biopsies in this low-income, predominantly Muslim country in order to design (...) an informed consent process. Methods: We conducted 16 group discussions with family members of persons who died during an outbreak of Nipah virus illness during 2004-2008 and 11 key informant interviews with their community and religious leaders. Qualitative researchers first described the post-mortem needle biopsy procedure and asked participants whether they would have agreed to this procedure during the outbreak. Researchers probed participants about the circumstances under which the procedure would be acceptable, if any, their concerns about the procedure, and how they would decide whether or not to consent to the procedure. Results: Overall, most participants agreed that post-mortem needle biopsies would be acceptable in some situations, particularly if they benefitted society. This procedure was deemed more acceptable than full autopsy because it would not require major delays in burial or remove organs, and did not require cutting or stitching of the body. It could be performed before the ritual bathing of the body in either the community or hospital setting. However, before consent would be granted for such a procedure, the research team must gain the trust of the family and community which could be difficult. Although consent may only be provided by the guardians of the body, decisions about consent for the procedure would involve extended family and community and religious leaders. Conclusions: The possible acceptability of this procedure during outbreaks represents an important opportunity to better characterize cause of death in Bangladesh which could lead to improved public health interventions to prevent these deaths. Obstacles for research teams will include engaging all major stakeholders in decision-making and quickly building a trusting relationship with the family and community, which will be difficult given the short window of time prior to the ritual bathing of the body. I am interested in looking at Krumpin’ through what I am calling the “politics of submergence.” If my world is chaotic, if my Blackness is my murderer, can I be expected to create beauty? Can my art be transformative? My paper argues that Krumpin’ is in fact transformative, not to the extent that it perpetuates hope, but maintains its social pessimism. In accepting both the conditions that have sustained the racial marginalization of African descended people, and the impotence of this (...) marginalized group to change the systemic social structures that continue racial subordination in the United States, Krumpin’ announces a reflective mode of racial identity and cultural existence that attends to the suffering of African-descended people in American ghettos. The purpose of this research is to present the major factors that lead to ethical dissolution in an organization. Specifically, drawing from a wide spectrum of sources, this study explores the impact of organizational, individual, and contextual factors that converge to contribute to ethical dissolution. Acknowledging that ethical decisions are, in the final analysis, made by individuals, this study presents a model of ethical dissolution that gives insight into how a variety of elements coalesce to draw individuals into decisions that (...) result in the ethical undoing of an otherwise healthy organization. ENRON, TYCO and WorldCom did not happen in a vacuum. Nor can such debacles be explained as simply one or two individuals who were morally corrupt. The ethical breakdowns that occurred in these companies happened over a period of time, involved numerous individuals both inside and outside of the organization, and brought about the implosion of viable companies. Seeking to extend the work of previous researchers, this study attempts to tie together a disparate set of factors into a cohesive explanation of ethical breakdowns in organizations. (shrink)

Categorization and decision making are combined in a task with photorealistic faces. Two different types of face stimuli were assigned probabilistically into one of two fictitious groups; based on the category, faces were further probabilistically assigned to be hostile or friendly. In Part I, participants are asked to categorize a face into one of two categories, and to make a decision concerning interaction. A Markov model of categorization followed by decision making provides reasonable fits to Part I data. A Markov (...) model predicting decision making followed by categorization is rejected. In Part II, a no-parameter model predicts decisions using categorization and decision responses collected in separate trials, suggesting that Part 1 results are not an artifact of the presentation of categorization and decision questions within a single trial. Decisions concerning interaction (defensive/friendly) appear to be based on information from the category decision, and not from the face stimuli alone. (shrink)
